It also turned out her cosigner had an eviction within the last 10 years, almost 20x open credit cards with 85% limit used up, and a recent bankruptcy that was "settled" in court (so the report says that the bankruptcy section was clean, but it did note the court case that was settled).

The other option is to go to court through a forcible detainer action, where the court is supposed to consider only the non-payment of rent in determining whether the Landlord can regain control of the space and its non-personal contents.If a bankruptcy is filed, then Landlord's rights are severely cut as federal courts trump local statutes, and leases.

We feel that the statements made by Passco were false at best and our trust in them has gone from being enthusiastic investors, to one that wishes the property would be sold and our investmet funds returned before this property goes into bankruptcy.
