Until then you cant do it unless there is a clause in the lease that once the property sells the new landlord has a right to end or amend the lease.

I think it would be reasonable to ask your agent to amend the compensation section of your agreement to state that you would only owe him additional Commision if he notified you before submitting your offer so that you can have some certainty.
