I've driven by the properties but i haven't been able to get on the properties to take a look for myself because they are currently rented out and the owner does not want me to disturb the current tenants. 

Check out Google Earth/Bing/ Google Maps for aerials of the yard and see when the ground was disturb. 

Please DO NOT DISTURB the occupant.

The seller will give more attention to your offer if you have knowledge about the property.Sometimes a seller wants you to make an offer before disturbing the tenants.

I know that many say leave it alone and don't disturb it,  it is ok as long as it is not airborne,  but in this house the HVAC system and duct work is in the attic which concerns me.  

Your loan letter should include their average closing time and the maximum amount you qualified for.Another thing you should do before starting making offers is to have a new office location that is convenient and has a minimal distraction that will disturb your working.  

And the most important thing is this: you only have to remediate it if you are disturbing it.

In effect that would mean a letter to the HOA property manager seeking enforcement of whatever of the rules or declarations make sense in terms of disturbing levels of smoke.
