Sounds like the "owner" isn't really the owner - at least not without probate.I recommend you consult with a probate attorney and go over the details with a fine toothed comb.

They're usually happy to talk with people and should be able to give you an idea of the feasibility of the project before you start dumping money into it This has been my experience too- the planning and zoning are pretty no nonsense which is easy to deal with...and yes, "fees" aplenty.
