I'm not really sure why the OP would want to do something that would result in a passive loss (that may or may not be deductible against other income) and active income subject to SE tax, but I don't know of any tax provision that would prohibit it.

And while there is no statutory prohibition - the IRS has tended to look at refinances right before a sale and 1031 as a way of pulling profit out.

Unless there are state or local laws (and there are) prohibiting discrimination based on source of income you can legally not rent to people on a non-garnishable source of income.

But in some jurisdictions there are no local laws prohibiting it and likely few to no local law enforcement will enforce federal laws...But, I think the point you are trying to make is worth noting - it is no longer hidden or considered taboo.

I don't know the laws of New Hampshire but most property law prohibits land locking property, meaning all parcels must have some form of legal access from public space to the property, whether through a permanent right of way, narrow deeded entry, or something similar.
