One of them is financially responsible but the other will have possession of the property and you also want them responsible.

But because a certain unsophisticated part of the populace believes he possesses hundreds of millions of dollars, he is targeting for lawsuits by the attorneys general of at least 3 states, as well as two private law firms trying to put together class action suits.

Spending $40k on legal fees to obtain possession of a home from a “aggressive” debtor is not uncommon.  

This article indicates that a chapter 13 allows them to maintain possession of the property and develop a plan to pay back their debts rather than be foreclosed on.

I have a client interested in purchasing a property, using hard money to also cover rehab cost, and then has a theory to appraise it and sell it to themselves in another LLC so they could pull a lump some without losing real possession of the property.

If they later said they didn't want to move in or couldn't, we would have them pay rent through when we re-rented the unit, because it wasn't rented due to their decisions.Since they never picked up keys, they don't have possession, so I don't believe an eviction would be necessary.

I believe it is a great strategy for those who are looking to get into real estate investing using a home they already possess.
