Often times scammer prey on people with limited money, marginal credit, etc. as they know they can sell them systems for a few K or take a small upfront fee and those people typically do not have the resources to fight it. ( The expense needed to possibly recover often exceeds what they lost). 

You should never fight to get someone out of their home unless it's truly serious - they're hurting themselves or others, unpaid rent, or creating a real continuing disturbance that is detrimental to the property. 

In my experience, when we have tenants move out after 1 year, it is almost always the properties with the owners who fight every time there is a maintenance issue or something that needs to be addressed.

Figuring out what can be negotiated and fighting for it is what it's all about.

If she didn't ask for special accommodations prior and you have documented proof that you tried to manage the noise, I would fight this.
