For the seller (John) to defer capital gains via a 1031 exchange, the sale proceeds must be reinvested into like-kind property within 180 days.

Proceed cautiously with this company. 

Need a creditor attorney ASAP, lenders are generally first for proceeds, but they absolutely will approve a plan you don't love.

Lucier@Jaime Farias I'm curious.... did you proceed via the options route, or did you end up using only assignable purchase agreements with the seller which is typically done by wholesalers? 

We tend to offer this to Owners to figure out the best route for them to proceed on development/building/renovating.

There are too many ways for it to go sideways and only one way for it to work (you stay on good terms with your ex and everything goes perfectly with the house, you split the proceeds fairly when you sell).
