If they were unwilling to sign, I would take that as a sign that they were not a serious buyer, and thus someone I should not put much effort into serving.

A better option might just be to do a subject to deal or seller financed deal but if they are unwilling to give up the title and deed then go with what you're doing.

@Dion DePaoli is right on about most lenders being unwilling to finance the units in your complex until the HOA is approved by these government entities making the mortgages much easier to sell off.
