Hello BP Community,Unless I am mistaken, Maricopa County (Phoenix, AZ) does not post their probate court records online, unless you can provide specific names or case numbers.

Our County Court Clerk provides the forms right on their website and it is literally a 15 minute cut and paste event to fill out the eviction forms.

However, we did have a tenant who stopped paying, and because of how impacted the eviction courts were, it took 6 months for him to get evicted.

However, it’s crucial to track and document all hours worked meticulously to demonstrate material participation if audited.The CPA’s suggestion that your activity would be treated as passive could stem from the involvement of a property manager, as their role could make it appear that you are not the primary manager of the rental.

We will see what the courts decide, just be aware of it. 

There are a couple of things that come to mind, if a payment is missed the lender cares, if the servicer goes out of business or misses a substitution of trustee, the lender cares, if the borrower goes to the lender to try to get removed from the loan (usually to buy another house) the lender cares, if the property gets caught up in a bankruptcy or divorce, the court cares and that means the lender gets involved.

Take all your analysis that you did for the deal to court so you can explain why they got the value wrong.
