If a DIL is given under forceful duress caused by the Mortgagee or with improper criteria it can be overturned and the Mortgagee can be fined.

I suspect at least in this case the lawyer representing the tenants would have a field day with your master lease after the fact.but if you set up the master lease before you move a tenant in on a sub lease maybe that works but it does preclude the other party to due notice and their day in court.this is the same as HML having borrowers sign DIL's at the inception of the loan.. that's not legal but done all the time and some that default just walk away but if anyone raised the issue the court would over turn the dil  in heart beat.

That alone would prevent you from getting title insurance.Also, in most places in California, owners can redeem the property up until the end of day before the auction occurs.Also, in California, there is a one-year statute of limitations for an owner to bring an action to overturn a tax sale.

@Alan DolenskyI'm new like you and have been instructed to use caution and use the inspector and GC for the first flip to get a better understanding of what to look for and to make sure that all stones have been overturned.

Went into the branch, they look up my loan number, and it had been "overturned", so they won't honor what they approved me for after a 30 day process of submitting every doc they requested.

Unless South Lake Tahoe's ordinance requiring a minimum 30 day rental contract is overturned in court, that may be the way we HAVE to go.
