I know this is an old thread that was resurrected, but I want to add some important info:In Massachusetts, you can't use just a title company, statute says you must use an attorney.

Generally these files are designated to not have any collections activity becuase it is a violation of the US Bankruptcy Court's statutes to collect on debt which is under BK proceedings.

I plan on doing a lot of them and don’t want to overspend on a corporate/lawyer trustee if ROI isn't there.From everything I’ve read, the effective and practical use of title holding trusts is mostly a learning curve because just like LLCs or IRAs missteps in implementation can invalid its purpose especially since statutes and case law are STATE BY STATE.

Your defendant's chair would be in a state court with reference to your particular state's statutes and case law.It is not universally accepted, as you state, that because your contingency to purchase a property is based on your ability to find a buyer that a judge will determine you to be brokering real estate.

hi Robert. as you already know or you will find out soon that Massachusetts is one of the hardest states in the country to get evictions especially on moms with 4 children.it sounds like she knows the Massachusetts statute on eviction and is using that by calling in the Board of Health whether she did it or boyfriend did it;she is an addiction waiting to happen.I would get started on filing the eviction sooner than later just document everything

Some state statutes have a set amount of years before the lien expires worthless if the owner doesn't redeem or the lienholder doesn't foreclose.Property is worth less than all the liens and foreclosure costs you incur.Property has EPA issues that need to be cleaned up if you end up owning the property after foreclosure.

If the judgement does not specify what to do with the SD then look to the state property codes to get the answer, most likely Florida statutes will allow you to keep all money that will pay for things they tore up.
