. - I'm not sure how NY laws specifically interact with contract law and labor laws, but from my experience in my market Mechanic's Liens are a great example of the manipulable holes in our system.The mechanic can certainly file a lien, with little or no evidence.

That said, it also depends on the extent of damage, totaled, then you have an issue.There seems to be an issue too with the city manipulating this setting him out for the time, which is an issue, contributing to the situation.We have had similar issues here, damaged homes in a flood plain, repairs can't be denied.

Of course the first step in not getting sued is dont be negligent AND be proactive, document that there are no trip hazards, that water heater is set to factory temp, gfi's are working etc etc.
