The trust does not provide liability protection AND the trustee is the 'defendant' when one sues a trust.

Some people may classify legal aide attorneys or public defenders as junior nitwits but these attorneys deal with this area constantly and get damn good at it.  

Not necessarily because of the risk it is overturned but the risk someone will challenge and they will have to pay the cost to defend that challenge.In most cases no one is going to come back to challenge even if they theoretically have the right to.

Defending lawsuits is a PITA and expensive.

But it cost my insurance company over $1 million to defend the suit. 

Also remember that anyone can sue anybody for anything, and defending a lawsuit is a great expense of time, money, and emotional energy.And just because "you" would not mind the inconvenience of putting up with a shedding tree for one month of the year and having to park on the street, that doesn't mean that your tenants won't mind.  

It wasn't long ago that KW was defending similar attacks against itself by the "big dogs". exp is growing rapidly, but I'm not kidding myself to think it'll put KW, ReMax or any others out of business, haha.
