I disagree with this.. its explicitly written to keep those that are not licensed from selling property under the guise of selling a contract.. but we will see there will be litigation and fines etc and case law will be laid down.. but it wont stop it.. too many folks could care less about these laws and will just do it until they are shut down etc.

On top of that, if you say something wrong, you can be liable for civil damages on top of criminal charges.I’ve had one signing with an investor, who is also a full time accountant with a government contractor,  and he explained his financing to me because it was different.

When we have dealt with this we were made aware that it is a civil matter where you would have to file with the courts. $5,000 isn't worth hiring a lawyer so you should file it in small claims court.
