Yes some people transfer the property anyway but my belief is that it's a recipe for trouble.  

The secondary will look to the sale as flag to some issue known only to the Seller and what will happen is you will see a discount which reflects the belief something is wrong with the asset or process.  

From the documents I read, they seemed to not be conforming to the SAFE Act and Dodd-Frank on the belief that they were exempt because they are doing contract for deed.  

@Derek Daun I can personally recommend Jay Hinrichs to you without hesitation, in fact I think you'd be misguided not to take his advice on the deal whether you move forward or not.
