Also their is a large tree next to the curb that is lifting up a portion of the sidewalk and her insurance said she needs to fix it in a years time or else they won't insure her so she is asking for that as well as the broken lining in the fireplace be credited.

I personally don't like fireplaces and if a property had one, I would say immediately when showing the house that the fireplace 'wasn't functional'.
