So, the financing party can hire an attorney, get a judgment and that judgment is acceptable for filing at the county. 

@Eric Helena, There is no statutory prohibition against purchasing from a related party to complete a 1031 exchange. 

We only charge third-party fees like the appraisal and the borrower pays the vendor directly.

If not you might be stuck with the work and the commitment to doing it since the city would be the ruling party.

In most cases due to the transaction sizes, there's very little margin for these 3rd party vendors (particularly brokers, property managers and contractors).
