There is probably water under the bridge now but if you sandwich the message in a positive way with appreciation for what he has done (on which he also doesn't earn commission until the sale goes through) and point out the benefits of working with you then I think it is better even then arguing or handing over the money (in which case he has received a reward for bad behavior ).
