I appreciate the response and you have a very valid point about the business partnership and making sure that we have everything ironed out and in writing before delving into this process. 

Not quite the same as real estate but works on a lot of the same principals ironically, and the ROI there would blow your mind (3% a month, so like buying a website for $10k would generate you $300 a month income). 

I have that all ironed out and can speak to it no problem.

Next time draft an iron-clad EMD provision which requires the title company to agree in advance as to an automatic release.Have a look at HUD's contracts.
