Given that you want a 60/40 division of anything, there tons of issues you should address in the partnership agreement beyond just the profit split.

1) seek attorney advice,2) mail letter stating that you have verbally been notifying him as these repairs for x month,  list ALL needed repairs, all future rents will be escrow3) email to him the same letter4) take a copy of that letter to your county's court house and request a rent escrow account (this is no charge in our county; don't know about your's)5) call your city's code enforcement division and ask about help with the list and if you can provide them with the letter/list6) make sure all future rents are paid in full/ on time to escrow.7) find another place to move ASAPThis will give the bad landlord a little 'slap on the wrist', maybe fined by city, maybe forced to make repairs, maybe be will have the escrow-ed funds released to you instead of LandLord after a court appearance.good luck.

I tried doing the MH thing out here, specifically for Nevada this state is not the state to be taking back notes as the MHD Manufactured Housing Division hates investors and has a barrage of laws in place to make it very difficult and punish and fine investors as well.
