You should have sent a letter, via Certified, Return Receipt Requested, politely and unemotionally detailing the issue and providing a reasonable deadline to remove it from your property, and without threats.

@Carlos MaldonadoI don't think you can backtrack all those steps since deadline has passed...But you still need to get form 1099R issued, report it on your tax return and pay the taxes.
