I don't know about your state but in Virginia in order to get recovery from the state licensing fund, we first have to obtain a judgment.

A few suggestion;- Deferred maintenance: How much life is left in the roof, heating, etc; just like any other RE- How has leasing been structured: Y-to-Y, 3 Y terms, Escalations, Recoveries, Options, etc- For the 'strength' of the tenants, if they are smaller tenants as I suspect, look at how long they have been at the property.

This is the general guideline:Construction defect litigation in which the HOA is the plaintiff are not considered a minor matter unless the HOA is seeking recovery of funds for issues that have already been remediated, repaired, or replaced.

I'm not sure when this article was written but I must say that from what we see globally, including Memphis, Real Estate is Not at 30 years low.There are always areas that are legging behind,while in the last 3-4 years most RE Markets experience reasonable growth, having Wall Street jumping in probably contributed to RE recovery we seeing now.

Hi @Brandon L.The people who reported this delinquency to the credit bureau i believe goes by one of these two names:Account Resolution Services, LLCHealthcare Revenue Recovery Group LLC Account Resolution Services, LLCI believe the original debt was charged off by the original creditor ( the hospital ) and bought by these people.I am not sure how it all works.

Here is what Fannie Mae has to say                                  Foreclosure                         Short SaleTime to buy               Primary 5 Years                   Primary 2 Years                             Investment 7 Years             Investment 3 Years                            FHA 3 Years                    FHA 3 Years but less if current at SSCredit             250 to 300 points                 depends on how many late paymentsLength on Credit    10 years +                     does not report as short sale recovery time         3 years +                       12 to 18 months with lates So basically the wait time is much shorter with a Short Sale, the Credit Impact is less and as mentioned above the deficiency judgement is usually waived with a short sale that is executed correctly, where in a foreclosure they are still on the hook for the deficiency.The exact times and credit scores needed vary on each circumstance and lender, but this is a pretty good general guide.Hope this helps!
