Try to get them to acknowledge that they are responsible, but don't worry about getting it fix or paid for now.  

just make sure they sign something that acknowledges that if they change their mind, you keep the holding deposit.

I prefer to get a written agreement with the tenant wherein they acknowledge it is month-to-month, what it takes to terminate, and that all other terms remain the same.

The city said there was nothing they could do about the drainage, though the mayor, our council lady and the storm sewer guy all acknowledge we have drainage issues.
