Dodd-Frank, I don't believe uses the words "lease-option financing" what you will find is that the DF encompasses the SAFE Act and establishes authority over any consumer RE transaction that is designed, intended to or facilitates the transfer of title in a 1-4 family dwelling by doing so.You will be very busy looking up the statutes that have been modified, adopted or the recension of regulations, going back to 1938 that I noticed.Much of this stuff lies in definitions, you can't just read the word "make" or "makes" or "maker" of a financial obligation and assume it means the same thing as a car maker or one who makes cookies, the English word has different applications.

I'm not an attorney, but I'm somewhat familiar with Maryland real estate law and practices (my wife has her real estate license in Maryland)...In Maryland, it is illegal for a pre-foreclosure sale to take place without a qualified intermediary (read the bill for definitions) facilitating the sale.

Also honor the money.. there are thousands of guys like us that can bring deals we are not the rare commodity its the money that needs to be honored .. my success working with private money for going on 4 decades is you have to understand what our role really is.. and its a facilitator of deals to think we are even partners with the money right out of the chute will usually lead to frustration..

FYI, if you request the funds, and the Buyer contests, the Title company can throw it into arbitration, which costs both parties money just to facilitate, and it will hold up your property.To avoid this in the future, make your earnest deposit NON-Refundable upon completion of the inspection and appraisal period.
