I was at a meetup a while back, and a wholesaler there said he would get properties under contract, with a clause that said "Pending partner approval."

Currently there are no units for sale in this building, there is one pending sale and 3 sold during the last year.

I understand what you are saying @Wayne Brooks, I may need a letter of intent... which is better... but I'll just have to go meet them and give them my answer to purchase in a day of two while my applications are pending...I have no choice... 

Oh, and the short sale comp which sold for $300,000 has since been remodeled, relisted for $99,000 more, and was pending at time of appraisal.

It appears that your project need to be turned over to a Title Attorney for resolution on a pending purchase through an Auction or otherwise.Here in Louisiana the Market is a lot softer for an investor.
