If you set up an LLC with only you and your husband as members (a single member by virtue of your joint tax return) and that LLC chooses to be taxed as a sole proprietor then it is what would be called a disregarded entity.

I don't think they can claim multi family owner occ.. were you can legally disregard federal fair housing laws.. as it sounds like two separate units they just happen to live next door.however they got in is moot they are in and are in the process of destroying this rental..

There is only one tax ID number for the Series LLC so the tax reporting if you are the sole member would be as a disregarded entity (pass through) and you would keep separate accounting records in your quickbooks to "tag" the income and expenses of each individual series (just like you would for separate LLC's). $1200 is expensive when you consider the alternative that I am suggesting is infinitely expandable at no additional costs for the rest of your life.

If your trust is revocable, it is disregarded for tax purposes so that shouldn’t cause an issue.
