I wouldn't do anything unless the police dept said its a issue,, you don't have proof and if police don't arrest then she probably wouldn't have a criminal report filed against her..I'd be aware of her actions and if you feel it's within your better judgement to let her move on just give her proper notice, she's month to month so your in perfect position to do a non-renewal you don't need a reason it's just you decided to not renew her lease again.

Tenant returned later that night, broke in, cops, etc... but they didn't arrest them bc "even if we did they wouldn't book them - jail is too full and this is too petty" and yes they are "crazy - but not crazy enough to admit them without their consent" Catching the cats took about 2 weeks.

I get it, its like someone getting arrested and say to the cop or judge " I didn't do it" I am sure they hear this from guilty people on a daily basis.

He did it again and got arrested and thrown in jail... was not pretty .I don't know anything about your state.. and I do see in Texas were its pretty common to tie up a property on an 100 option.. but the buyers and sellers are all fully aware of what is going on.. the way you made your post and the subsequent advice you were seeking and given clearly indicated that your sellers are not fully up to speed on your motivations and your end game.
