If the seller did what you suggested and went out and gave a deed to a third party who was unaware of the first grantee's interest, yes, the third party may have a better claim to title than the first buyer, but that doesn't mean the seller had title to pass, only that the recording statues are intended to protect innocent third parties.

I use patterned ones that look like granite or marble or quartz or similar so that stains and minor scratches don't show, and don't use a shiny surface - use as close to matte as possible - and light colors.
