I have heard you have to own land with all permits and engineering completed before closing on the construction loan exclusively in California. 

Do they provide exclusive leads, or are they shared among multiple investors?

.- You mentioned this sale is tax free 121 exclusion, which is great, and seems like a solid start to your goal.- The townhouse you're moving into is currently a rental, but you plan to live there two years for the 121 exclusion.

If they gift the land, it falls under the annual gift tax exclusion ($18,000 per recipient in 2024) or the lifetime gift exemption ($13.61 million in 2024).
