Why not just get a loan from your 'partner' if you are unable to front the whole down payment.

If you wholesale a particular contract, but INTEND to complete the purchase even if you are unable to wholesale it, then you are a PRINCIPAL not an intermediary and as such owe no other duty to the seller.
