If the one doing the marketing does not own the property that they are marketing they are marketing a property "for another" no matter what they choose to tell themselves.This is no more a misinterpretation than I am an astronaut or big purple cartoon dinosaur...All laws are open to interpretation in this country what do you think lawyers and judges do for us everyday...

A deposit is intended and interpreted by many courts to be refundable unless there is damage or other more firmly calculable damages, what I'm seeing above is arbitrary.
