Contract was standard Oregon form, with the bank's contract amended to it, but it seems even their own contract doesn't allow them to back out.

You can always add anything you need in an amendment.

Very good that you amended all your expenses into percentage of rent.

If you release one, the lease (which was also signed by the other) probably needs to be amended or re-executed. 

I would have put that in the original offer to purchase, or at least in the amendment after the inspections, you hopefully knew about this by then.
