A well written management contract should clearly spell out what is expected of both the PMC and the owner, to PROTECT both and avoid misunderstandings.

When its included in a lease for real estate then the laws pertaining to residential rental security deposits in your state apply but when its separate you should have more leeway to get some additional deposit to protect you.

More importantly, they will help make sure that all the paperwork is done properly, that you fully understand all the moving parts of the transaction, and that your interests are protected from contract to close.

I agree with the others when they say to hire a PM; a property manager will have access to better screening and fraud detection - and hopefully can add some protections in the legal arena too.
