The other issue I have had was water, they said I was not liable and a water affidavit was in place but my PM says the tenant needs to take to the county and have it switched plus pay a deposit so I will probably never happen since its hard enough getting the rent from them.

If you're living in it now, you'll probably be required to have a signed lease in place as well as proof that first month's rent/security deposit were collected in order to get a DSCR loan (they're business purpose loans and don't allow owner occupancy).
