I don't care for the "hard money" term either, it denotes a flavor of a title loan company, pawn broker or street front leg breaking loan shark.

An LLC is a hybird of the corporation.Here, an LLC is a form of a corporate entity, not a C-Corp, an S-Corp or a Not For Profit or Non-Profit Corporation (but I do understand that some states allow for non-profit LLCs).A single Member LLC is difficult, IMO, to maintain the distance between your personal actions and corporate actions, I'm speaking of the flavor, proving a clear difference between the two.

Again, investing with your money is fine, buying a note, if you're in a partnership that can change the flavor and become a brokerage situation.Thing about buying illegally is that you could put yourself in a situation where you could not enforce the terms of the loan if the debt was acquired in violation of law.I suggest you talk to an attorney, you'll want to know that the debt was initially made in compliance.

I did this last year actually on a second.Another caution here, speaking of just buyer notes, as Dion like to mention "class" there is a difference between loans funded with cash and obligations as paying equities and purchasing equity notes can complicate the flavor as part may become viewed as a cash obligation to a point (when purchased at a discount) and the equity amounts of the unpaid balance.

Between the buyer and seller, those "life occurances" that mess things up were rather light with only two mentioned, death and bankruptcy with the reaffirmation of the debt agreement, being a good thing, if it's accepted by a trustee.Considering the marketing flavor, excepting that out of the information, considering he is an attorney, I'd say it's a B-... understand I'm speaking as to RE financing and not his legal opinions.
