Furthermore the attorney said I'd have to cover the tenants lawyer cost if I brought them to small claims. 

And you can tailor it to you, so 1) You certainly don't have to charge 100% while vacant (dependent on bldg. layout, thermostat access, etc.) and 2) You can tailor the Gas/Electric as you have brought up so maybe 50/50 all except 60 unit 1/40 unit 2 for electricity... etc. 

My partner brought in this deal and we had investors looking for this kind of deal.

Along the same timeline we contracted another property and after a day or two realized that his loan product would not fit that particular property so we promptly told him that we were going to go with a different lender and the guy got very upset and went off on us etc. etc. and even brought up the properties that came back with the lower appraisal.

And even fewer understand that a house built 50 years ago doesnt have to be brought up to todays code . 

When the lender brought up the issue, he just said that he needed more backyard space for his kid and it was a non-event.

I cant go into what he did to me because there's an open case but would be happy to speak with anyone that wants to know how to get in contact with the department aiding in the charges brought on him.
