To add another twist to this, it seems that Real Estate Licensees get special consideration as rental activities including acquisition, sale, and management of those rental properties may be considered NON PASSIVE (active) due to the professional occupation. -- I am a real estate broker.

If you put a property under contract for X amount then sold the paper to someone else for X amount + $20,000 one could come back and make the argument that the only way you put it under contract for X is because you used your superior real estate knowledge gained by being a licensee to misrepresent to the seller the value of their home for your personal game.
