Otherwise, Massachusetts law (M.G.L. c. 239, § 8A) allows tenants to terminate their lease and vacate an uninhabitable unit, and they should be entitled to a refund of any prepaid rent for the period after the unit became uninhabitable.

Closing costs can include points used to buy down the rate as well as pre-paids which can vary wildly depending on time of month/year, so that may speak to the difference there.
