We got a sympathy card for a previous offer falling through on the fault of the seller, so we were offered this house for the same price as the previous house.

My sympathies to sellers these days that get screwed over by these game players.

@Aaron PhillipsPlease accept my sympathies on this, the first time in this business that a snake swallowed up your time and toil only to slither out of a verbal agreement on you.I can promise you that it won't be the last time.As far as legal options go, you have none worth pursuing.If you should take it into your head that extra-legal options are the way to go...my advice is to wait six months and see how you feel about it then.

He gave you bad checks from a closed account and clearly cannot afford the apt anymore.You must do what is necessary to protect your investment.If he wanted your sympathy he should have been straight with you in the first place.

I am not asking for your sympathy, I am not begging for your respect. 

They had to know there would be a legal fight, so my sympathy on goes so far.

@Joe Splitrock  not getting much sympathy for the 350k a year bay area family :).. but I agree.. its the same premise I tell folks that want to buy rentals that only have 500 a month in rent.. and to rent you only need 3x.. so you have 1500 gross minus 500 in rent another 200 in utls phone etc. and your tenant is living on 200 a week.. pretty unstable.. take a 1200 rent do the same 3X which is common and now same tenant same town is living on 2400 a month or 800 a week Before tax of course.. but you get the drift.so same thing with the 350k earner with the 7 to 10k mortgage they still have plenty to live on prices of staples are the same in SF as other areas. gas is a  little more but since if your smart you have a Tesla and your not buying gas anyway and you can now get a brand new never been used Tesla in about 60 days for 35k cash ..
