Saying it wasn't in the lease or @Kevin Sobilo saying it just comes down to one person's word against another would negate virtually every crime.   

I hired a surveyor,  engineer and ran through the process with the city myself.

Nothing like word of mouth referrals.Either way you definitely want a way to check/verify their work before hiring them.
