I called the clerk of courts and not surprisingly, they tell me that they file like that all the time and the only way I can get it discharged is by having the GC file the discharge release.

@Veronica Veiga If you're travel nursing and get both of your units rented and is cash flowing you could possibly get a servicing company to show that the debt is being "serviced" (Paid) by other parties and would not count as debt against you.I have no experience doing this myself but it is the root how a buyer can purchase a house Sub to (subject to the existing mortgage) and have the seller still qualify for a new loan in their name despite having not discharged the previous loan.

No one has ability to file bk that makes a difference, and bk on your record whether discharged or not is last case worst worst case scenario.

You'll also likely require putting additional sheetrock on the ceiling, and a rear egress from the unit that discharges to a public right of way/street (if you don't have this--like your building is connected on both sides--you'll need an easement from the neighbors, which is another additional expense).
