If ever asked you'll want to use that along with other things to demonstrate your intent such as discussions with your cpa, your past history, rent advertisements, etc.Ultimately it comes down to an opportunity cost exercise - what are you giving up by having that property now - if you can buy better and for longer holds with less costs then the 1031 would let you do that without paying tax.

Anything beyond that, that is what travel insurance is for and they should have exercised that option if/when available.

The goal is to have done some DD on the top property and have PSA signed before locking in 3 choices so at that point other 2 are just fillers.So when my client is selling their property I often try to see if they put a clause in there where after buyer goes hard with EM purchasing their property the seller at their discretion can exercise an additional 30 day extension before they close to start the 45 day ID period.The NNN properties get multiple offers sometimes dozens of offers the demand is so strong.

She is violating the lease in a few minor ways such as having two additional animals that aren't in the lease and a boyfriend who has moved in even though he is not on the lease.I am willing to let her stay until the end of her current term this year despite these infractions, but once this term is over, I want either sign a new lease with her or find a new tenant who will pay current market rents.So my question is, are these infractions grounds to not honor the existing lease should she choose to exercise her extension clause once this current term comes to an end?
