I think Bill's confusion comes from being familiar with a combined PA containing the escrow instructions or his forgetting that the escrow instructions are just a contract telling the escrow agent exactly how to transfer title and under what conditions.

It is a bit overly convoluted but if the lender is comfortable with that they should be willing to say they would do the refinance once the all the shifting around takes place.Also keep in mind, you may have to pay transfer taxes each and every time you move the title around like that.

Although they did request LLC documentation & the addendum to the Op Agreement regarding the decision to buy said property from the initial buyer along with the sales contract (we avoided a double closing or an assignment per se).What was interesting is that I think they were looking for a transfer of ownership @ the same price as what it was originally purchased for by the initial buyer.

I never heard of and "affidavit of heirship" Here in Maryland you would have to open an estate to transfer the title to the sellers. unsure of whether she can sell with the less than full ownership Well I am sure.

The deed transfer date would end up being listed as before the deed/contract restriction expired (despite holding off on recording), and you'd be opening yourself up to a lawsuit from the lender.
