That lawsuit was actually settled in 1953 and commissions have been negotiable ever since then (they were fixed prior to that).

You thought an extra $240k, they thought an extra $300k, and you settled on $270k.The new taxation for the seller is:- nothing now- if exercised in 2025, they sold the property for $330k in 2025- if expired in 2025, they keep your $60k and report ordinary income of $60k in 2025

NOW, if there was a recent storm that cause a sudden leak resulting interior damage you may not have much of a leg to stand on because HOA was not neglegent in doing timely repairs, it just happened.Now if you think they should repair but they won't you will have to sue your HOA (yourself also since you are an owner) Once they board and HOA recieve the letter from your attorney, they will likely just settle and fix your wall inside since it will be way more costly to defend and it may raise they HOA insurance next year, thus passing the cost to you via your HOA dues.

If you are currently in a large city and plan to stay there then you have more options, but if you are not sure where you are going to land then you might want to get ready and be prepared but wait until you get settled into that first good job so you don't need to move out of your new triplex 6 months in.
