BUT.... if a person is an ready interested buyer, ok, that changes things, that resolves that issue for enforcement. 

Some ego on all sides creeping through to protect ones own interests (which isn't a bad thing by itself, it can just be dangerous over the long-run) that may be making the convo even more challenging to resolve. 

In the meantime, I had asked my tenant not to use that shower until this is resolved.

Consider the downside (what if you take them to court and end up with nothing) before you jump in the deep end.I hope this situation resolves itself for you and doesn't put you off of investing in real estate.

Building finally resolved and remediated it this year and now i am selling the property.
