It looks like you are doing an affordable build based on the cost but hard to say since you didnt provide info on the build itself such as square footage and finishes.

So that the tenant rent is providing a larger amount of return of capital.

It's not illegal provided you're dislosing it to all parties and not trying to actively hid it.
