Rather than doing a hold back and accepting a title that's clouded with a lien which could be a problem if you want to sell or use the property to obtain a mortgage down the road from a not so accepting a buyer/lender, didn't the grandmother/seller pay off the bondsman and become the surety herself leaving the property free and clear?

Yeah and what is a tad worse, is they have recorded a memorandun that clouds title and "forget" to release it.

Now, can I record a memorandum of agreement for the home to our county’s recording office to cloud the title until I’m returned my money ?

My question is, would it be possible to get a clear title on this property if I were to purchase it, then use an attorney to have the cloud (unreachable heirs) removed?

In some states, when record owners file a quiet title to remove clouds from the title,  they first have to send a quitclaim deed to the adverse possessor for signature.
