The first tenant says their stuff smells like cigarettes all the time as a result (they live above the suspected smokers).The smoker denies they smoke in or around the house, but I’ve seen the cigarettes around the house and have reason to believe the complaint.The lease clearly says no smoking allowed in the house or within 30 ft of the structure.

Be careful when turning tenants away, and make sure your reason for doing so is well documented, as many statutes protect tenants from being denied for wrong reasons.

No reason to deny this request.

You can always deny them if they don’t meet your criteria or they don’t pan out.People are still moving though and there are still qualified applicants out there (I just filled a vacancy last month).
