They could work with an existing lender, do some marketing to help broker, get a cut and make FARRRR more $ with zero risk vs this EMD lending. 

Sounds like they are dumping a bad 1031 property into a REIT and spreading the financial burden upon existing REIT members. 

Equity first comes in the form of down-payment, but you can also force it into existence with rehab or wait for it with appreciation.This is why it is so important that you re-invest your cash flow into more equity.

I think this business plan exists in all types of real estate and non-real estate businesses.

Our experience is that many lenders/servicer customer representatives may not know the protections that exist for those that want to put asset protection steps in place. 

In a rare case, it could be the second lien that is forclosing meaning the first lane still exists, and you would be on the hook for that.
